Terms of service

Pre-contractual terms for the founding review. Mandatory consumer rights remain unaffected.

1. Provider

These terms govern the Backtest Evidence Review service offered by Xavier Gisbert Blanquer, acting as a natural person under the Backtest Evidence trading name, Carrer Enginyer Vilaplana, 22, 03803 Alcoi, Alicante, Spain, NIF 21693925A, contact hello@backtestevidence.com, under the laws of Spain.

2. Service scope

Fixed-scope methodological risk screening of one backtest based on materials you provide: scorecard, five ranked evidence risks, one suggested next experiment, one evidence verdict category, one clarification round. Details in FAQ.

Not included: investment advice, trading signals, strategy development, parameter optimization, running untrusted code, exchange access, legal/tax advice, full backtest reproduction, or certification that no leakage exists.

3. Price and taxes

Founding cohort price: €79 total per review unless otherwise agreed in writing. For consumers, any applicable VAT is included in that displayed total; no tax is added at checkout beyond the displayed total. Business invoices state the tax treatment applicable to the billing details supplied.

Payment via Stripe Payment Link (primary) or invoice where agreed. Ready buyers may checkout directly; asking before buying is optional.

4. Ordering and pre-contractual steps

  1. You purchase via Stripe checkout on the site (or via invoice where agreed). Stripe collects acceptance of these Terms and the Privacy Policy.
  2. Optional: you may email an optional fit check before buying. That ask is not required to purchase.
  3. After payment is verified, you receive the client intake link and a temporary Proton Drive Editor folder link by email (not via a public thank-you page link).
  4. For consumers: before I begin substantive work, the intake/email collects any required express request to begin during the withdrawal period and acknowledgment of the consequences of full performance. Stripe’s general Terms/Privacy acceptance does not replace that specific consumer confirmation.
  5. I do not begin substantive work until payment is verified, intake is complete (including applicable confirmations), and files are in scope.
  6. If the purchase is clearly out of scope before substantive work begins, I refund in line with section 7 / applicable withdrawal rules.

5. Delivery

Report delivered within 2 business days after complete intake and files received within stated limits. Business days are Monday to Friday, excluding public holidays applicable at the provider's professional address. The clock pauses if materials are incomplete or over limits until resolved.

6. Clarifications

One async clarification round on the delivered report within 7 calendar days of delivery. No new strategies or scope expansion.

7. Commercial cancellation (voluntary)

This section covers voluntary commercial cancellation by agreement. It is separate from the statutory right of withdrawal in section 8.

If the purchase is clearly out of scope before I begin substantive work, I will refund in accordance with these terms (and statutory withdrawal where applicable).

If you ask to cancel before I begin substantive work on your materials, I will refund any payment received, or offer rescheduling by agreement. For voluntary cancellations outside a valid statutory withdrawal, Stripe processing fees that are not recoverable may be deducted from the refund by agreement.

If you ask to cancel after I have started work (and you are not exercising a valid statutory withdrawal), a reasonable portion may be retained corresponding to work already performed; we will agree in writing where possible.

8. Right of withdrawal (consumers)

Where you qualify as a consumer under Spanish and applicable EU law, you have a 14-day statutory right of withdrawal for distance contracts, subject to the statutory rules and exceptions. This right is distinct from voluntary commercial cancellation (section 7).

If you validly exercise the statutory right of withdrawal, any refund due will not deduct Stripe processing fees. You will be refunded the amounts paid for the service in accordance with applicable consumer law.

If you expressly requested that performance begin before the end of the 14-day period and you withdraw before the service is fully performed, I may charge only the proportionate amount corresponding to the service already provided up to the time you informed me of withdrawal.

Once the service has been fully performed (report delivered), the right of withdrawal may be lost if you gave prior express consent to begin performance and acknowledged that you would lose the right of withdrawal upon full performance.

The model immediately above is provided as the withdrawal form for this service. Using that exact wording is optional; any unequivocal statement sent before the applicable deadline is accepted.

9. Limitation of liability

The service is educational methodology feedback. I do not guarantee finding of all errors or specific outcomes. Liability is limited to the amount paid for the affected review except where liability cannot be limited by law.

10. Complaints

Contact hello@backtestevidence.com. Receipt of a complaint will be acknowledged within 2 business days and a substantive response targeted within 14 calendar days. An official consumer complaint form will be provided where applicable.

11. Governing law

Spanish law governs these terms without depriving consumers of mandatory protections of their country of residence. For consumers, jurisdiction is determined by mandatory consumer rules. For non-consumer clients, the parties submit to the courts corresponding to the provider's professional address, unless mandatory law requires otherwise.
